§1
General provisions
1. The eGrzałki.pl online store [hereinafter referred to as the "Store"] conducts retail sales through the Store Owner via the Internet, pursuant to these Regulations [hereinafter referred to as the "Regulations"].
2. The owner of the Store is: SAGED Jarosław Sieczka Radom, Wincentego Witosa 16, NIP: 7962619195, tel. 732 415 435, e-mail address: zamowienia@egrzalki.pl.
3. Whenever the term Customer appears in the document, it means any entity placing an order.
4. The Regulations are an integral part of the sales agreement concluded with the Customer.
5. The condition for concluding a sales contract is the acceptance of the Regulations by the Customer when placing an order by checking the appropriate box in the form.
6. Prices given in the Store are gross prices (including 23% VAT), according to Incoterms: EXW Radom.
7. Goods available in the Store are free from physical and legal defects.
§2
Orders
1. Orders can be placed as follows:
- via the form available on the Store's website,
- by email to the address available on the Store's website,
- by phone to the numbers intended for placing orders, available on the Store’s website in the Contact tab.
2. The condition for the order to be fulfilled is that the Customer provides data allowing for the verification of the Customer and the recipient of the goods. The Store confirms the acceptance of the order by e-mail or telephone.
3. The parties are bound by the information contained on the Store's website next to the purchased goods at the time of placing the order, in particular: price, characteristics of the goods, its features, elements included in the set, method of delivery, with the reservation regarding the delivery date §4 point 4.
4. The information on the Store's website does not constitute an offer within the meaning of the Civil Code. By placing an order, the Customer makes an offer to purchase a specific product. The sales agreement is concluded at the moment the Store confirms the acceptance of the Order for execution.
5. In the case of personal collection or through a courier ordered by the Customer, the Customer declares the date of collection. In the event of a significant exceedance of the collection date, the Store has the right to charge the Customer for storage costs.
6. In the event of failure to collect the purchased goods or failure to pay for the ordered goods within 30 calendar days from the date of placing the order, the Store has the right to withdraw from the contract.
§3
Payments
1. The customer can choose the payment methods specified in the Payment methods tab.
2. Shipping prices are specified in the shipping price list.
3. The condition for the release of goods is payment for the goods and shipment.
4. The payment card operator is PayPro SA Settlement Agent, ul. Kanclerska 15, 60-327 Poznań, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court of Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under the KRS number 0000347935, NIP 7792369887, Regon 301345068.
§4
Fulfillment and shipment of goods
1. The Store sends the ordered goods via shipping companies (e.g. courier companies) or makes them available for collection.
2. In the case of payment by payment card, the order processing time is counted from the moment of positive transaction authorization.
3. In the case of payment other than cash on delivery, the shipping time is extended by the period between placing the order and the date the payment is credited to the Store's bank account or sending the transfer confirmation.
4. The Store is not responsible for changes in the delivery date due to reasons beyond the Store's control. The availability of some goods is an approximate value provided by the manufacturers/suppliers of individual products. Due to the fact that some goods are shipped directly from the warehouses of the manufacturers/suppliers of individual products, the Store reserves the right to exceed the deadline given in the product description, while making every effort to ship within the given deadlines.
5. If the order cannot be fulfilled, the Store will immediately inform the Customer.
§5
Complaints
1. In the event of non-conformity of the goods with the contract, the Customer should return the complained goods to the Store together with a description of the non-conformity.
2. The Store will respond to complaints from Customers who are Consumers within 14 days of receiving the goods subject to the complaint.
3. If the implementation of a justified complaint involves sending a new product to the Customer or removing the non-conformity, the delivery costs are borne by the Store.
4. The Store reserves that differences in the photos of the Goods resulting from the individual settings of the Customer's computer (colour, proportions, etc.) cannot be the basis for a complaint. In addition, the photos are often indicative (these are photos of a given type of heater) and the appropriate technical parameters are provided in the description of the item.
5. The standard warranty is 12 months for all products, except for those in the description of which a different warranty period is clearly indicated.
6. The amount of warranty claims cannot exceed the net value of the goods subject to warranty claims.
7. Liability for defects does not apply to natural wear and tear, nor to damages resulting from incorrect or negligent handling, excessive use, inappropriate operating materials, improper storage or chemical, electrochemical or electrical influences that are not intended for the given type of product.
8. The store excludes liability under warranty.
9. The Store's liability related to the conclusion of a contract or the sale of goods does not include compensation for damages related to expected benefits, lost profit, production losses, loss of market reputation, etc.
10. Heating elements modified by yourself, including those bent by yourself, are not covered by the warranty. This also applies to heating elements that have the information "intended for bending" in their description. The warranty only applies to heating elements previously modified and bent by SAGED.
§6
Right of withdrawal
1. Pursuant to the Act on the protection of certain consumer rights and on liability for damage caused by a dangerous product of 2 March 2000, a customer who is a Consumer has the right to withdraw from the contract.
2. A Customer who is a Consumer may withdraw from the sales agreement without giving reasons by submitting an appropriate written declaration within 14 (fourteen) days from the date of delivery. To meet this deadline, it is sufficient to send the declaration before it expires.
3. In the event of effective withdrawal from the sales contract, the contract is considered not to have been concluded. The customer is obliged to return the purchased goods immediately, no later than within 14 (fourteen) days.
4. Within 14 days of the customer withdrawing from the contract, the Store Owner will refund the funds to the Customer.
5. The customer does not have the right to withdraw in the cases specified in the Act referred to in paragraph 1 above, i.e. in the cases of:
- provision of services commenced, with the Consumer’s consent, before the expiry of 14 days from the date of conclusion of the contract;
- relating to audio and visual recordings and those recorded on computer data carriers after the Consumer has removed their original packaging;
- contracts for services for which the price or remuneration depends exclusively on price movements on the financial market;
- services with properties specified by the consumer in the order placed by him or closely related to his person (custom-made heaters);
- services which, due to their nature, cannot be returned or whose subject matter is liable to deteriorate rapidly;
- press delivery;
- gambling services.
§7
Privacy Policy
1. The administrator of personal data is the Owner of the Store.
2. Personal data provided to the Store Owner is provided voluntarily, with the reservation, however, that failure to provide certain data will prevent the submission and execution of the Customer's order.
3. The Customer may also express separate consent to receive advertising and promotional materials from the Store, including a trade newsletter.
4. The Customer has the right to access and correct their personal data, demand the cessation of their processing and object to their processing.
§8
Intellectual property
1. It is prohibited to use any materials published on the Store's website (including photos and descriptions of goods) without the written consent of the Store.
§9
Entry into force and amendments to the Regulations
1. These Regulations come into force on the date of publication on the Store's website.
2. These Regulations may be changed, and information about changes to the Regulations will be sent to Customers to the email address indicated in the order 14 days before the amended Regulations come into force.
3. Additionally, changes to the Regulations will be published on the Store's website 14 days before the new Regulations come into force.
4. All orders accepted by the Store Owner for execution before the date of change of the Regulations are executed on the basis of the regulations that were in force on the date of placing the order by the Customer.
5. If the Customer does not accept the new content of the Regulations, he or she is obliged to notify the Store Owner of this fact within 14 days from the date of notification of the change in the Regulations.
§10
Final provisions
1. In matters not regulated by these regulations, the provisions currently in force shall apply.
2. By accepting these Regulations, the Customer consents to the processing of his personal data by the owner of the Store and entities acting on his behalf in the country and abroad, in connection with the performance of sales agreements for goods offered by the Store and for marketing purposes related to the business activity conducted by the Store. The Customer has all the rights resulting from the Act of 29 August 1997 on the protection of personal data (Journal of Laws of 1997, No. 133, item 883, as amended), in particular he has the right to inspect his own data.
